These Terms and Conditions govern your use of marketupp.com and any services provided by Marketupp.

By using this website, submitting an enquiry, accepting a proposal or purchasing our services, you agree to these Terms and Conditions.

1. Our Services

Marketupp provides digital marketing services, including:

  • Social media management
  • Content strategy and creation
  • Search engine optimisation
  • Performance marketing
  • Video editing
  • Personal branding
  • WordPress website design
  • Marketing consultation

The exact services, deliverables, fees and timelines for each project will be stated in the relevant proposal, quotation, invoice or service agreement.

2. Starting a Project

Submitting an enquiry or booking a meeting does not automatically create a client relationship.

A project begins after:

  • The scope of work has been approved
  • The proposal or quotation has been accepted
  • The required initial payment has been received
  • Necessary information and account access have been provided

Marketupp may accept or decline a project based on availability, requirements, budget or suitability.

3. Scope of Work

Marketupp will provide only the services included in the approved proposal or agreement.

Any request outside the agreed scope may require additional fees and a revised timeline. This may include extra content, additional platforms, urgent delivery, new website pages or major changes to previously approved work.

4. Client Responsibilities

The client must provide accurate information, brand assets, content, account access, feedback and approvals required to complete the project.

The client is responsible for reviewing all content, designs, campaigns and information before final approval or publication.

Delays in providing information, feedback, payment or access may result in an extension of the project timeline.

5. Content Approval and Revisions

The number of revisions included will be stated in the project proposal.

A revision means a reasonable adjustment to the existing work. A completely new concept, design, strategy or direction may be treated as additional work.

Once content or a deliverable has been approved, further changes may require an additional fee.

The client is responsible for checking names, prices, dates, offers, claims and business information before approving content.

6. Payments

Service fees and payment schedules will be shared through a proposal, quotation or invoice.

Unless agreed otherwise:

  • Work begins after the required advance payment
  • Recurring services must be paid according to the agreed billing schedule
  • Advertising budgets and third-party charges are separate from our service fees
  • Additional work may be invoiced separately

Marketupp may pause services or withhold final deliverables if a payment is overdue.

7. Cancellations and Refunds

Payments for completed work, work already started or resources already allocated are generally non-refundable.

If a project is cancelled, the client will remain responsible for:

  • Work completed before cancellation
  • Approved third-party expenses
  • Resources already committed to the project
  • Any outstanding invoice

Any project-specific cancellation or refund terms stated in a proposal or agreement will take priority.

8. No Guaranteed Results

Marketupp provides services using research, professional judgement and reasonable care. However, digital marketing results depend on several factors outside our control.

We do not guarantee:

  • First-position Google rankings
  • A fixed number of followers
  • Viral content
  • A specific number of views
  • Guaranteed leads or sales
  • Platform verification
  • A fixed return on advertising spend

Results may be affected by competition, algorithms, audience behaviour, budget, offers, pricing, website quality and the client’s sales process.

Any forecast or expected result is an estimate—not a promise.

9. Advertising Services

For performance marketing projects, the client is responsible for the advertising budget unless agreed otherwise.

Advertising spend is separate from Marketupp’s management fee. Platforms such as Google and Meta control campaign approvals, account restrictions and advertising policies.

Marketupp is not responsible for advertisements rejected or restricted by a third-party platform. We also cannot guarantee a particular cost per lead, number of conversions or return on advertising spend.

10. Account Access

Clients may need to provide access to social media, advertising, analytics, hosting or WordPress accounts.

Marketupp will use this access only to provide the agreed services.

Clients should maintain ownership of their accounts, use strong passwords and enable two-factor authentication wherever possible. Sensitive credentials should be shared through a secure method—not through the public contact form.

11. Intellectual Property

The client retains ownership of logos, photographs, videos, brand assets and other materials supplied to Marketupp.

The client confirms that they own these materials or have permission to use them.

Marketupp retains ownership of its internal systems, templates, frameworks, methods and unused concepts.

Unless agreed otherwise, the client receives the agreed rights to final approved deliverables after full payment has been received.

Third-party fonts, stock images, music, plugins and software remain subject to their original licence terms.

12. Confidentiality

Marketupp will take reasonable care to protect confidential business, account and project information shared by the client.

Confidential information will not be intentionally disclosed unless:

  • It is required to complete the project
  • The client gives permission
  • Disclosure is legally required
  • The information is already publicly available

The client must also keep Marketupp’s non-public processes, proposals and internal materials confidential.

13. Third-Party Services

Our work may involve third-party platforms such as WordPress, Google, Meta, social media networks, hosting providers, plugins, scheduling tools and analytics services.

These platforms operate under their own terms and policies.

Marketupp is not responsible for third-party outages, price changes, account restrictions, data loss, policy updates or service discontinuation.

14. Website Use

You may not use this website to:

  • Carry out unlawful activities
  • Submit false or fraudulent enquiries
  • Attempt unauthorised access
  • Introduce malicious software
  • Copy or republish our content without permission
  • Interfere with the website’s security or performance

Marketupp may restrict access if misuse or a security threat is detected.

15. Limitation of Liability

To the extent permitted by law, Marketupp will not be responsible for indirect losses, lost profits, platform changes, search-ranking changes or business opportunities lost because of third-party services or circumstances outside our control.

Nothing in these Terms excludes any liability that cannot legally be excluded.

16. Termination

Marketupp may pause or terminate a project if:

  • Payments remain overdue
  • Required information or access is repeatedly withheld
  • The client requests unlawful or misleading work
  • Communication becomes abusive
  • The agreement is materially breached

On termination, the client must pay for completed work and approved expenses incurred before the termination date.

17. Privacy

Personal information collected through this website is handled according to our Privacy Policy.

By using the website or submitting an enquiry, you acknowledge that you have reviewed the Privacy Policy.

18. Changes to These Terms

Marketupp may update these Terms when our services, website or legal requirements change.

The latest version will be published on this page with an updated effective date.

Changes will not alter an existing project agreement unless both parties agree or the change is required by law.

19. Governing Law

These Terms and Conditions are governed by the laws of India.

Both parties should first attempt to resolve any disagreement through direct, good-faith communication. Unresolved disputes will be subject to the jurisdiction of the competent courts in India.
